These terms apply when you use the CabBooks app and this website. By creating an account, you agree to them. Please read them with our Privacy Policy, which explains how we handle your personal data.

If you downloaded CabBooks from Google Play or the App Store, that store's own terms also apply to the download and to any payments you make there.

CabBooks is provided by Cabbooks Ltd, a company registered in England and Wales with company number 17360173. In these terms, “we”, “us” and “our” mean Cabbooks Ltd, and “you” means the person who has a CabBooks account.

CabBooks is software for self-employed taxi and private hire drivers. It lets you:

• keep digital records of your income and expenses;
• connect to HMRC and see your quarterly update deadlines;
• send quarterly updates for your self-employment income under Making Tax Digital for Income Tax;
• see HMRC's estimate of your tax;
• download your records as a CSV file.

CabBooks does not make your final declaration. After the tax year ends, you will need to use other software that HMRC recognises, or an accountant or agent, to do that.

CabBooks is not HMRC, and we are not your accountant or tax adviser. We do not give tax or financial advice. If you are not sure about your tax, speak to an accountant.

To use CabBooks you must be 18 or over, self-employed, and taxed in the UK.

You use CabBooks for the purposes of your business, not as a consumer. Your account is for your own business only. You must not use it to keep records or send updates for anyone else.

Keep your password and two step verification safe, and do not share your account. If you think someone else has used your account, tell us straight away at hello@cabbooks.online.

CabBooks needs an internet connection to save and show your records. It does not work offline.

You are responsible for:

• making sure the records you add are accurate and complete;
• checking a quarterly update before you send it. We only send an update to HMRC when you tell us to;
• meeting HMRC's deadlines;
• keeping your business records for as long as the law requires. You can download them from the app at any time;
• your tax affairs. Using CabBooks does not change what you owe HMRC or what HMRC expects of you.

The tax estimate in CabBooks comes from HMRC and is based on the quarterly updates you have sent so far. It is not your final tax bill. It will change as you send more updates, or if you have other income. Do not rely on it as the amount you will pay.

Keeping your records in CabBooks is free. To send quarterly updates to HMRC and see your tax estimate, you need a subscription.

• The price is shown in the app before you buy.
• You pay through Google Play or the App Store, not to us directly.
• You pay in advance for each period you choose.
• Your subscription renews automatically at the end of each period until you cancel.
• You can cancel at any time in Google Play or the App Store. Your subscription stays active until the end of the period you have paid for.
• We cannot cancel a subscription for you. Only you can, in Google Play or the App Store.
• If your subscription ends or a payment fails, you can no longer send quarterly updates or see your tax estimate. Your records stay free to use.
• Refunds are handled by Google Play or the App Store under their own rules.

If we change our prices, the new price applies from your next renewal, and the store will tell you before it does.

Cancelling your subscription does not delete your account or your records. To do that, see “Ending your use of CabBooks” below.

The records you add to CabBooks belong to you. You allow us to store, copy and send them only as needed to provide CabBooks to you, for example to send a quarterly update to HMRC when you ask us to.

Once a record is saved it is never changed. To fix a mistake you add a correction, and the original stays visible next to it. This keeps a true history of what was recorded and sent to HMRC.

We take care to protect your data and keep backups, but you must keep your own copy of your records. Download them from the app regularly. See our Privacy Policy for how we handle your personal data.

We keep your information confidential. We only share it as our Privacy Policy describes, when you ask us to, or when the law requires it, for example because of a court order. This continues after your account is closed.

We help with questions about using CabBooks. We cannot answer questions about tax, accounting or the law. Check anything important with an accountant before you rely on it. We aim to reply as quickly as we reasonably can, but we do not promise a set response time.

We only look at your account data when you ask us to help with a problem, or when we need to keep CabBooks working and secure, for example to find out why a quarterly update failed. We may stop helping anyone who sends abusive or offensive messages.

When you use CabBooks you must not:

• try to get into anyone else's account, or into our systems;
• try to break, overload or get around the security of CabBooks;
• copy, change or reverse engineer the app, except where the law allows it;
• use automated tools to access CabBooks;
• add records you know are false, or use CabBooks for anything illegal.

If someone makes a claim against us because you broke these rules or used your account for someone else's business, you will cover our reasonable costs of dealing with that claim.

You understand and agree that:

• CabBooks is provided as it is. We work hard to make it reliable, but we cannot promise it will always be available, uninterrupted or free from errors;
• HMRC's systems, the app stores, your phone and your internet connection are outside our control, and can make CabBooks slow or stop it from working;
• it is up to you to decide whether CabBooks meets the needs of your business;
• CabBooks is not a substitute for advice from an accountant or tax adviser;
• nothing we tell you, through support or otherwise, adds to the promises in these terms;
• we may change, add or remove features. If we remove something important, we will tell you first.

As far as the law allows, we do not give any promises about CabBooks other than those set out in these terms.

Our total liability to you for anything to do with CabBooks is limited to the subscription fees you paid in the 12 months before the claim.

We are not liable for loss of profit, loss of business, or any indirect loss. We are not liable for HMRC penalties or interest, unless they were caused by our failure to send a quarterly update that you correctly told us to send.

We are not liable for any loss caused by you, or by anyone you let use your account.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

The CabBooks app, website, name and logo belong to Cabbooks Ltd. Using CabBooks does not give you any rights in them, other than the right to use the app under these terms.

You can stop using CabBooks at any time. To delete your account, choose Delete account in the app's menu. This deletes your records and everything else we hold about you, so download your records first. Deleting your account does not cancel a subscription in Google Play or the App Store, so cancel that too.

We may suspend or close your account if you break these terms or misuse CabBooks. Where it is reasonable, we will warn you first and give you time to download your records.

If we ever stop offering CabBooks, we will give you reasonable notice so you can download your records.

Neither you nor we are responsible for delays or failures caused by things outside our reasonable control, such as a failure of HMRC's systems or one of our providers, a power cut, an internet outage, fire, flood, war or government action.

We may update these terms from time to time. If we make an important change, we will tell you by email or in the app before it takes effect. If you keep using CabBooks after that, you accept the updated terms.

Send any notice to us by email at hello@cabbooks.online, or any other address we tell you about. We will send notices to you at the email address on your account. A notice counts as given when the email is sent.

• If a court decides part of these terms cannot be enforced, the rest still applies.
• If we do not enforce a term straight away, we can still enforce it later.
• We may transfer our rights and duties under these terms to another business. If we do, that business takes over our duties to you, and we are no longer bound by them.
• These terms and our Privacy Policy are the whole agreement between you and us about CabBooks.
• No one other than you and us has any rights under these terms.

These terms are governed by the law of England and Wales. Only the courts of England and Wales can deal with any dispute.
